People who are still employed are protected by Michigan no-fault insurance law in the event of a car accident or truck accident. The law requires that their insurance companies pay up to 85 percent of their wages for up to three years of missed work, within certain limits.

Michigan's no-fault insurance legislation was passed in 1973, which was a historically tough time for Michigan's autoworkers. The law takes into account that hardworking people often face layoffs for short periods.

If you have a history of employment, but had the misfortune to be involved in a car accident while you were unemployed and looking for work, you can still collect the same wage loss compensation you would ordinarily be entitled to — even if you were not working at the time. Your wage loss claim will be based upon the wages you received at your last job. You must demonstrate that you were looking for employment at the time of your disabling injury.
